Salgar Diving SL (¨our, us, we”) has developed a website and an online payment system which enables individuals to browse, compare and pay (the “Payment”) Services and Activities directly with us.
By browsing, accessing and using the Website and by using the Online Payment System, you acknowledge and agree that you have read, understood, and agreed to these terms and conditions.
The Parties agree as follows:
1. Scope of Service
(a) Payment created through the website will constitute a direct contract between You and Salgar Diving SL. You are solely responsible for reading and understanding the Salgar Diving Terms and Conditions prior to making a Payment.
(b) Information is accurate, up to date, and not in any way misleading. Salgar Diving does not guarantee that the information is free from errors.
(c) Salgar Diving may ask customers to comment on all aspects of the Diving Services provided and may post such reviews on the Website.
2. Privacy
Salgar Diving SL is committed to protecting and safeguarding your personal information. Salgar Diving SL will only collect, use, and disclose personal information in accordance with the Privacy Policy. By using the Website and Payment System you confirm that you have read the terms of Salgar Diving SL´s Privacy Policy, and you agree and confirm that the terms of the Privacy Policy are reasonable.
3. Prices
Services and activities displayed on Salgar Diving SL´s Website are offered at the standard price (in € Euros, including VAT) available with respect to the applicable dates, per person or activity. An extra charge will be applied for any extra services required by you, such as the rent of equipment, purchase of insurance or any other services rendered that are not specifically included in the Products (Activities) description.
4. Availability
Salgar Diving SL guarantees to provide you with the Services purchased on our website during a period of 5 days of your choice. At all times, you will have to confirm availability for any Activity directly with us. Most of our offered Services and Activities depend on Instructor availability and Weather Conditions. Therefore, specific day and time of your Activity will be arranged directly between you and Salgar Diving within a period of any 5 days.
5. Payment
If you wish to purchase any product or service made available on our website, you may be asked to supply certain information relevant to your Purchase including, without limitation, your Name, Address, Telephone Number, email address and the dates you wish for the Activity to take effect. All transactions are processed through a gateway provider (PayPal) and are not stored or processed on our servers.
6. Cancellation
We will not charge a cancellation fee provided that the reservation is cancelled during the no-charge cancellation period.

7. Special Circumstances
We reserve the right to cancel or suggest an alternative date and time provide our Services in the event that weather conditions make it unsafe to provide our services at a date specified. If we are permanently unable to deliver our services as a result of acts of God, volcanic eruptions, tornado, tsunami, flood, natural disaster, fire, acts of war, or riots, we will use commercially reasonable efforts to inform you without delay and will refund you without deduction any amounts collected.
8. Responsibility
By booking Diving Services through the website, you agree that you reviewed our standards and requirements, including but not limited to minimum diving certification requirements, diving insurance requirements, your personal health information (Medical Statement or Certificate), Liability Release or Assumption of Risk Agreement forms. You are responsible for understanding and complying with the requirements and we encourage you to inquire with us about requirements prior to making a reservation. Failure to comply with the requirements may result in your inability to use the Diving Services, and late cancellation fee may apply.
9. Communication
Our website provides a communication channel through which you may contact us directly to request additional information, or to confirm reservation details, such as the meeting time and location.
10. Personal Use Only
You agree that you will not use the Website for any purpose other than personal, non-commercial use. You will not use the information for a competitive use and will not copy, post, display, download, reproduce, re-sell, scrape, or deep-link any information, content, services, products, images or software on the Website without explicit reference to Salgar Diving.
11. Intellectual Property
Salgar Diving SL is the exclusive owner of all right, title, and interest in and to all intellectual property with respect to the Website. By posting reviews or comments, you grant us a non-exclusive right to use, reproduce and amend your reviews or comments at its sole discretion for the purpose of informing future customers. You agree that we may decide to remove your reviews or comments from the Website at its discretion, such as in the event that it deems your reviews or comments to be offensive.
